In a recent article published in, a drug-maker announced it was buying the generic version of Viagra and Pfizer Inc.'s erectile dysfunction drug Cialis.
The acquisition is the largest one-time price increase in the history of the drug — about $10.8 billion — and will be the most significant one for the drugmaker, according to Mylan Inc. Chief Executive Jeff Goodman.
Viagra was introduced in May and Cialis was launched in July.
The drug is the subject of a new round of litigation and potential drugmaker consolidation. Pfizer, which is based in San Diego, is seeking $5 billion in back equity in the company.
The deal is the second time this year in which Pfizer has agreed to pay $5 billion to settle lawsuits involving the erectile dysfunction drug.
The drugmaker will pay $10.8 billion to resolve $1 billion in lawsuits over alleged improper marketing of the erectile dysfunction drug.
The two-year litigation is expected to last through Dec. 31, 2010.
Last year, Pfizer agreed to pay $9 billion to resolve $1.3 billion in lawsuits regarding a marketing of Viagra, Cialis, and the prescription of Viagra Connect, an erection-relieving drug, as well as related Pfizer products like the cholesterol drug Lipitor and the blood pressure drug Norvasc.
The drugmaker also reached an agreement to settle more than $1 billion in consumer safety lawsuits over a marketing of Cialis, a heart medication, as well as related Pfizer products including Norvasc and the blood pressure medication Plavix.
The drugmaker also entered into an agreement to pay $4.2 billion to resolve $4.1 billion in claims over claims that the erectile dysfunction drug increased the risk of bladder cancer. In 2010, Pfizer reached an agreement to pay $3 billion to resolve $2.7 billion in claims related to the marketing of Viagra.
In addition to the three Pfizer-based products, Pfizer and Teva Pharmaceuticals, which are expected to receive about $3 billion in settlement awards, the drugmaker has also reached an agreement with the Israeli company Teva Pharmaceutical Industries to settle more than $1 billion in claims related to Viagra, Cialis, and the prescription of the erection-relaxing drug Levitra, among other generic products.
Pfizer and Teva will continue to pursue a lawsuit over a marketing of Cialis, but the company said it is not seeking to settle any of those claims.
In addition to the drugmaker, Pfizer is facing an investigation by federal prosecutors in connection with marketing of Viagra. The company had been ordered by U. S. prosecutors to stop marketing Viagra, Cialis, and similar products, and Pfizer agreed to pay a $2.7 billion penalty.
A probe by the Food and Drug Administration found that Pfizer’s marketing of Viagra increased the risk of bladder cancer, though the drug maker had never disclosed the increased risk.
In 2011, the FDA rejected a lawsuit by a company seeking to recover about $16 million from the FDA and the company that had paid for the marketing of the product.
A settlement agreement was reached with the FDA in October 2011 after an investigation into marketing of Viagra, Cialis, and similar products.
A Pfizer spokesman, Jim Bourg, said: “The companies are committed to vigorously defend themselves in all available legal options, including against the FDA and the litigation.”
He added: “Pfizer and Teva will continue to pursue the litigation, ensuring they continue to uphold their legal rights as they have for the FDA and for other legal matters.”
Pfizer, which is based in New York City, has filed a lawsuit against the company that it bought in October 2010 from a group of generic drugmakers.
A Pfizer spokesman said Pfizer “is aware of the litigation and believes it has the resources to seek a fair resolution.”
